法律免责声明

产品及交付

ECU Remap Center 以专门根据客户订单创建的电子文件形式开发定制车辆管理软件。订单确认后，将根据客户的规格开发文件。处理并付款后，文件将立即在客户帐户中可用并通过电子邮件发送。每个购买的数字文件都将存储在我们的服务器上，客户可以在三十 (30) 天内下载。
付款和产品交付后，将立即生成并提供发票。

客户

鉴于产品的极其特殊性，ECU Remap Center 仅以 B2B 方式向专业车辆改装师销售其产品，这些专业车辆改装师在车辆改装方面经过充分培训、教育和熟练，并且无需任何第三方的教育或帮助即可改装车辆。

通过订购或购买 ECU 重映射中心客户确认他或她是一名专业的车辆改装师，接受过培训并且对车辆改装过程有广泛的了解。

支付方式

您可以使用 MasterCard、VISA、AMEX 信用卡、Paypal 或银行转账支付产品和服务费用。所有信用卡交易均使用 Mollie 安全支付系统和 w我们在任何时候都不会处理或存储客户的信用卡或付款信息。

有限保修

ECU 重映射中心对于因未提供正确的车辆详细信息、安装额外硬件、车辆维护不当、第三方对所提供产品进行任何修改或安装程序错误而导致的任何车辆故障，我们概不负责。客户在车辆中实施调校软件/调校文件的风险由客户自行承担，因此不在保修范围内。

然而，在极少数情况下，如果软件中存在故障，并且可以确定是由于提供的校准本身固有的特定问题，我们将提供有限保修。如果在购买文件交付后 30 天内报告，ECU Remap Center 将向客户提供修订后的软件来解决故障。为了证明他们的身份和文件的所有权，用户必须通过他们的用户帐户和购买的项目页面专门报告软件问题。

客户同意，除与产品本身相关的内容外，他们不会向改装车辆的车主做出任何陈述或保证。

在任何情况下，客户都可能需要遵循基本和合理的步骤，向 ECU Remap Center 提供足够的数据，以便做出明智的判断，找到令人满意的解决方案。未能提供所要求的基本信息，或未能访问车辆以直接确定此信息，可能会导致 ECU 重映射中心自行决定不再提供进一步的支持，并且退款将被拒绝。

退出和退款权利

撤回权

购买产品时，客户有权在 14 天内无理由终止协议。此反思期从客户或客户指定的代表在通知公司后收到产品之日起开始。
在此反思期内，客户应妥善保管产品、任何配件和包装。
客户只能在能够决定是否要保留该产品的范围内打开或使用该产品。
如果客户行使其退货权利，他应根据 ECU Remap Center 提供的合理且明确的指示，将产品及所有配件（在合理可能的情况下）以原始状态和包装退还给公司。

如果客户想要使用其退货权利，他应在收到产品后 14 天内通知 ECU Remap 中心。
在向公司发出使用退货权的通知后，客户应在 14 天内退回产品，并提供发货证明作为及时退回产品的证据。

如果客户没有给出任何使用退货权的通知，也没有将产品退还给 ECU Remap Center，则购买具有约束力。

如果客户使用其退货权利，则客户承担的费用将不超过退货费用。

请注意：14 天冷静期不适用于根据客户要求制作的在线数字内容，如果您已经开始下载，并且您同意，在开始执行时您将失去撤回权。

退货和退款

ECU Remap Center 确保其产品和服务符合协议的要求、报价中规定的规格、合理的可靠性和适用性标准以及协议签订时有效的法律要求和法规。

ECU Remap Center、制造商或进口商提供的任何保证均不会削弱客户根据协议对 ECU Remap Center 行使的合法权利和索赔。客户必须在交货后两周内以书面形式通知 ECU Remap Center 任何缺陷或错误交货。产品必须以原包装和全新状态退回。

ECU Remap Center 的保修期与制造商的保修期一致。但是，ECU Remap Center 不对产品最终是否适合客户个人使用负责，也不对产品应用的任何建议负责。

下列情况不适用保修：

所交付产品的任何维修或其他工作均由客户或第三方完成。
交付的产品暴露在异常条件下或被不负责任地处理，违反了 ECU Remap Center 提供的使用说明或包装上注明的使用说明。
缺陷全部或部分是由于（未来）有关所用材料性质或质量的立法规定造成的

数字服务退款 - 无退款政策

订购定制调音文件和解决方案时，客户需要为工程师所做的工作付费，而不是为工作成果付费。我们致力于提供优质产品和全面支持。所有劳动都必须得到补偿，因此，我们不提供软件修改和解决方案的部分或全部退款。确认此定制数字产品不退款政策，即表示您同意放弃退货权。

在极少数无法达成解决方案的情况下，我们会将等值的数字代币退还到用户的虚拟钱包，可用于未来的服务。

Limitation of Liability and Indemnification

The client acknowledges and accepts that ECU 重映射中心 and its beneficiaries shall not be held liable for any indirect, incidental, consequential, or similar damages or losses incurred by the client. This includes, but is not limited to, financial and commercial prejudice, loss of profit, loss of sales, increased costs and overhead, loss of clientele or image, disruption to the client’s business planning, or loss of data, files, or computer programs resulting from the use or inability to use the Products. Any claim from a third party against the client is considered indirect damage and shall not give rise to any compensation from ECU Remap Center.

Without prejudice to mandatory statutory provisions, ECU Remap Center’s liability shall strictly be limited to the price of the relevant software or digital token(s) purchased. In no event shall ECU 重映射中心 be liable for damages incurred by the end-user (owner of a vehicle tuned by the client).

Furthermore, ECU 重映射中心 explicitly disclaims liability for:

Damages caused by incompetent use of the products or use for a purpose other than that for which they are objectively intended;
Damages caused by materials or services provided by third parties without the prior written consent of ECU 重映射中心;
Any direct or indirect damages and/or costs resulting from improper actions, carelessness, negligence, misconduct, or improper maintenance of the products by the client;

Any claims from the client’s customers resulting from the client’s failure to fulfill pre-contractual information obligations.

Indemnification: The client agrees to fully indemnify, defend, and hold harmless ECU 重映射中心 against all liabilities, costs, expenses, damages, and losses (including legal fees) suffered or incurred arising out of or in connection with any claim made by a third party related to the supply or use of the Products, to the extent that such claim is attributable to the acts, omissions, or modifications performed by the client or their employees, agents, or subcontractors.

Legal Compliance and Off-Road Use Policy

Off-Road & Competition Use Only: The user acknowledges that software modifications affecting emissions control systems (including but not limited to DPF, EGR, AdBlue/SCR, and Catalyst deactivation) are intended strictly for off-road, competition, and closed-circuit racing use only. These modifications may not be legal for use on public roads or highways under applicable laws, such as the US Clean Air Act, EU Regulation 715/2007 (Euro 5/6), or other national standards.

User Responsibility: It is the sole responsibility of the vehicle owner and the client to ensure the vehicle complies with all relevant local, state, and federal legislation. The user agrees to use the Software only for activities that do not violate the laws of the country of usage. ECU Remap Center (anbitec group d.o.o.) shall not be held liable for any illegal modifications performed on vehicles registered for public road use. It is the user’s explicit duty to verify the legality of power increases or emission system deactivations in their specific region before application.

Client Information Obligation: The client, acting as a professional seller or service provider, has the mandatory obligation to properly inform their end customers of the legal implications of tuning their vehicle. By agreeing to these general terms and conditions, the client undertakes to comply with this pre-contractual information obligation. ECU Remap Center makes no representation or warranty regarding the homologation of a tuned vehicle and does not grant any authorization for said vehicle to be operated on public roads.
